تحكم في أجور رؤساء المجالس البلدية والولائية الذين تم تزكيتهم من طرف الصندوق في انتخابات نوفمبر 2017، معايير وشروط تتقدمها الكثافة السكانية والموقع الجغرافي. حيث تم اعتماد سُلم أجور جديد سنة 2013 يضبطه مرسوم تنفيذي وقعه الوزير الأول الأسبق، عبد المالك سلال، يخص كلا من رؤساء المجالس الولائية ونوابهم ورؤساء اللجان الدائمة لهذه المجالس ورؤساء المجالس البلدية ونوابهم وكذا المندوبين الخاصين للبلدية ورؤساء اللجان الدائمة.

ويتقاضى رؤساء البلديات التي بها كثافة سكانية تقل عن 10 آلاف نسمة،  تعويضا إجماليا قَدره 77 ألف دينار، في حين تُمنح للذين يسيرون بلديات تقطنها ما بين 10 آلاف إلى 20 ألف نسمة أجرة قدرها 88 ألف دينار. ويُحدد النظام التعويضي الجديد أجرا يتعدى 99 ألف دينار لرئيس بلدية يصل تعداد سكانها إلى 50 ألف نسمة.

وتُمنح للمير الذي يشرف على قيادة المجلس البلدي الذي فيه كثافة سكانية تتراوح مابين 50 إلى 100 ألف نسمة، مبلغ 11 مليون سنتيم. ويصل الأجر إلى 12 مليون بالنسبة للبلديات التي تصل فيها الكثافة السكانية من 100 إلى 200 ألف نسمة، وسيستفيد رئيس المجلس الشعبي البلدي لأكثر من 200 ألف نسمة من أجر يتعدى 13 مليون سنتيم.

أما نواب رؤساء المجالس الشعبية البلدية فسيتقاضون أجورا تتراوح بين 5 إلى 10 ملايين سنتيم، حيث يعين النواب الذين يمكنهم مساعدة رئيس المجلس الشعبي البلدي بصفة دائمة ورؤساء اللجان الدائمة كأعضاء دائمين بناء على طلب من رئيس المجلس الشعبي البلدي، بموجب قرار من الوزير المكلف بالداخلية. بينما سيتقاضى رؤساء اللجان الدائمة أجورا تتراوح ما بين 4 ملايين لتصل إلى 9 ملايين سنتيم. وكذلك الأمر بالنسبة للمندوبون البلديون الخاصون.

 نظام تعويض لرؤساء المجالس الولائية يتأرجح بين 9 و16 مليونا

ومكّن المرسوم التنفيذي، رؤساء المجالس الولائية من نظام تعويضي إجمالي يتأرجح بين 9 ملايين إلى 16 مليونا وذلك بالاعتماد على مؤشر تركيبة المجلس أو بمعنى آخر عدد أعضاء المجلس.

ويُحدد مبلغ العلاوات الشهرية الممنوحة لرئيس المجلس الشعبي الولائي ونواب الرئيس ورؤساء اللجان الدائمة الذين يمارسون مهامهم بصفة أعضاء دائمين.

وسيتقاضى رئيس مجلس ولائي يضم 35 عضوا أجرا يتجاوز الـ9 ملايين سنتيم، أما رئيس مجلس ولائي يضم 39 عضوا فسيصل أجره إلى 10 ملايين، أما رئيس المجلس الولائي الذي يضم 43 عضوا فسيتقاضى 12 مليونا، والمجلس الولائي الذي يضم 47 عضوا 14 مليونا، في حين يصل سقف النظام التعويضي لرئيس مجلس ولائي يضم 55 عضوا 16 مليونا. ويتراوح المبلغ التعويضي لنواب رؤساء المجالس الشعبية الولائية ورؤساء اللجان الدائمة من 75 ألف دينار إلى 14 مليون سنتيم.

وزيادة على العلاوات، يتقاضى رؤساء المجالس البلدية قيمة منحة التعويض على المنطقة تصل 15 ألف دينار لرؤساء المجالس البلدية والمندوبين البلديين الخاصين 10 ألاف دينار.

وعندما تكون العلاوة، أقل من الراتب أو الأجر الذي يتقاضاه المنتخب بعنوان منصب عمله في هيئته الأصلية المستخدمة له، فإن العلاوة المدفوعة ينبغي أن تكون موافقة للراتب الشهري الذي كان يتقاضاه في منصبه الأصلي قبل انتخابه.

ويستفيد المنتخبون غير الدائمين من علاوة شهرية للتمثيل تقدر بـ10 ألف دينار بالنسبة لأعضاء المجالس الشعبية البلدية، و15 ألف دينار بالنسبة لأعضاء المجالس الشعبية الولائية. وتعتبر التعويضات في هذا المرسوم التنفيذي نفقات إجبارية تتكفل بها كل من ميزانية الولاية والبلدية. وعندما لا يمكن أن تتحمل ميزانية البلدية والولاية النفقات الناجمة عن ديمومة نواب رؤساء المجالس الشعبية البلدية والولائية ورؤساء اللجان الولائية الدائمة، فإنه يتعين على الجماعة المعنية أن تطلب إعانة من السلطة العليا لتغطية هذه النفقات.

وترسل المداولة الخاصة بطلب هذه الإعانة مرفقة برأي الوالي إلى الوزير المكلف بالداخلية لاتخاذ القرار. وفي حالة الموافقة، تحصل البلدية أو الولاية على إعانة تخصص لموازنة ميزانيتها.

الضمان الاجتماعي والتقاعد

ويظل المنتخبون المحليون خاضعون في مجال الضمان الاجتماعي والتقاعد، لأحكام النظام الذين كانوا ينتسبون له عند تاريخ انتخابهم.

وفي هذه الحالة، تكون الاشتراكات في مجال الضمان الاجتماعي والتقاعد التي تقع على عاتق كل من المنتخب والجماعة المحلية مساوية للاشتراكات المنجزة على أساس الراتب أو الأجر في منصب العمل. وينتسب المنتخبون المحليون المستفيدون من العلاوات الذين لا يشملهم الضمان الاجتماعي عند مباشرة مهامهم إلى النظام العام للضمان الاجتماعي ومعاش التقاعد المنصوص عليهما في القوانين والتنظيمات الجارية بها العمل.
